I understand that there are risks and dangers inherent in participating in the activities of BetterLife in Recovery, its partners, sponsors and beneficiaries. I acknowledge that such risks anddangers include, but are not limited to death, illness, serious bodily injury, and property loss. Ialso understand that in consideration for being permitted to participate in a Better Life inRecovery event, I hereby take the following actions, for myself as well as for my heirs, assigns,next of kin, successors, executors, administrators, and legal representatives: I hereby releaseBetter Life in Recovery, its sponsors, its partners and beneficiaries, its leaders, its employees,and volunteer staff from liability whatsoever arising out of injury, sickness, or damage, which maybe sustained by me during the course of activities sponsored by Better Life in Recovery, partnersand beneficiaries.I do further give my consent for the director or properly appointed leader of Better Life inRecovery, its partners and beneficiaries to secure the administration of medical treatment ormedication for myself in case of an emergency. I do further agree to the performance of treatment,anesthetics, and operations deemed necessary for me in the opinion of the attending physician.I understand that my insurance coverage will be used as a primary coverage in the event medicalintervention is needed. I hereby indemnify and hold harmless Better Life in Recovery, itssponsors, its partners and beneficiaries from any and all liabilities or claims made by otherindividuals or entities as a result of any of my actions during a Better Life in Recovery event,including any litigation, expenses, attorney's fees, loss, liability, damage or cost which may occuras a result of any such claims.I understand that while I participate in any activities organized, administered or sponsored byBetter Life in Recovery, its partners and beneficiaries, I am responsible to abide by the rules setforth by the sponsoring organization, its leaders, and supervisory personnel. Any seriousinfraction of the rules and/or conduct by myself can result in dismissal from the event. I, theundersigned, agree to assume the cost of such actions. I also agree to forfeit any possible refund.I understand that Better Life in Recovery, its partners and beneficiaries are non-profitorganizations and contributions are tax-deductible with the exception of cash. Better Life inRecovery, its partners and beneficiaries have complete discretion and control over the use of alldonated funds. All donations and payments are non-refundable and non-transferable.I, the undersigned, hereby consent to the use of any video recordings, photographs, slides, audiorecordings, or any other visual or audio reproduction in which I may appear by Better Life inRecovery, its partners and beneficiaries. I understand that these materials may be used forpromotion of Better Life in Recovery, its partners and beneficiaries, which includes fundraisingefforts.I release Better Life in Recovery, its partners and beneficiaries from any liability connected withthe use of my picture or voice recordings as part of any promotional or fundraising program.The information that I have given during registration to Better Life in Recovery, its partners andbeneficiaries is accurate and true to the best of my knowledge. I certify that I am at least 18 yearsof age. If not, my parents are in full knowledge of my participation. I have carefully read thisWaiver and Release of Liability and fully understand its contents. I am aware that this is a waiverand release of liability and I sign of my own free will.ActNow Promotions Waiver: I understand running is a potentially hazardous activity. I should not enter and participate unless I am physically fit, mentally able and properly trained. I agree to abide by any decision of the race officials relative to my ability to safely complete the run. I certify I am in good health and properly trained to run the distance of this race. I assume all risks associated with running in this event, all risks being known and being appreciated by me. I understand my entry fee is non-refundable. Having read this waiver and knowing these facts, and considering your accepting my entry into this running event, I, for myself and my estate, heirs, survivors, descendants and anyone on whose behalf I may act (including all minor children and charges and their estates heirs and survivors), do hereby permanently and forever completely give up, surrender, waive, release and terminate any and all claims or liabilities of any kind, arising in tort, contract or otherwise, against ActNow Promotions/Racing, and their respective officials, directors, trustees, agents, volunteers, employees, sponsors and affiliates arising from my participation in this event, including but not limited to claims arising out of past or future negligence or carelessness on their part. I hereby consent to the use of image in photographs, videos and other recordings for promotional purposes.Registration fees are nonrefundable.
