Release of LiabilityFairbanks Community Fun Run 5K, 10K and 0KI understand that my, or my minor child’s, or the minor child in my legal custody (collectively “my”) participation in the Rotary Club of Springfield Southeast’s Fairbanks Community Fun Run 5K 10K 0K (“Event”) is at my own risk. I understand that there are risks associated with participating in the event, including, but not limited to, possible falls, contact with other participants, effects of weather, traffic, and road conditions. I agree not to participate in the Event unless I am physically able and properly conditioned. I hereby indemnify, defend, and hold the Rotary Club of Springfield Southeast, and each of their affiliates, subsidiaries, officers, directors, volunteers, representatives, agents, insurers, and any and all other persons or entities acting on their behalf (collectively, “Rotary Club of Springfield Southeast, and all sponsors of the Event (“Sponsors”), the City of Springfield (the “City”), the Drew Lewis Foundation, The Fairbanks and all other individuals and entities in any way assisting or connected with this Event harmless from and against any and all claims, liability, judgement, fines, and expenses, including all attorney’s fees and amounts paid in settlement actually and reasonably incurred in connection with any proceeding, to which the Rotary Club of Springfield Southeast , Sponsors, Drew Lewis Foundation and/or the City is, or at any time becomes a party to or is threatened to be made a party due to my participation in the Event.On behalf of myself and my minor children, our next of kin, heirs, administrators, executors and assigns, I hereby release, discharge and covenant not to sue the Rotary Club of Springfield Southeast, Sponsors, Drew Lewis Foundation, The Fairbanks and/or the City FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON ACCOUNT OF ANY INJURY, including but not limited to, personal injury, death, or damage to property arising from or related to my participation in the Event. This release, discharge, and covenant not to sue shall include ALL CLAIMS, DEMANDS, LOSSES, OR DAMAGES CAUSED OR ALLEGED TO BE CAUSED, IN WHOLE OR IN PART, BY THE NEGLIGENCE OF the ROTARY CLUB OF SPRINGFIELD SOUTHEAST, SPONSORS, DREW LEWIS FOUNDATION, THE FAIRBANKS AND/OR THE CITY.I hereby grant to the Rotary Club of Springfield Southeast, with respect to photographs, motion pictures, video recordings, or any other record of the Event, in which I may be included, to copyright the same in its own name or otherwise; to use, reuse, publish, and re-publish the same in whole or in part, in conjunction with any printed matter in any and all media now or hereafter known, and for any purpose whatsoever, including, but not limited to, illustration, promotion, art, advertising, or trade and to use my name and any statement made by me in connection herewith if the Rotary Club of Springfield Southeast so chooses.I also acknowledge and agree to the following:• No reimbursements for the Event will be given due to inclement weather.I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, AND I UNDERSTAND AND AGREE THAT, BY SIGNING BELOW, I AM GIVING UP SUBSTANTIAL RIGHTS I WOULD OTHERWISE HAVE TO RECOVER DAMAGES FOR LOSSES OR INJURIES CAUSED OR CONTRIBUTED TO, DIRECTLY OR INDIRECTLY, BY FAULT OR NEGLIGENCE OF THE ROTARY CLUB OF SPRINGFIELD SOUTHEAST, SPONSORS, DREW LEWIS FOUNDATION, THE FAIRBANKS OR THE CITY, and ENTER THIS WAIVER AND RELEASE OF LIABILITY VOLUNTARILY.ActNow Promotions Waiver: I understand running is a potentially hazardous activity. I should not enter and participate unless I am physically fit, mentally able and properly trained. I agree to abide by any decision of the race officials relative to my ability to safely complete the run. I certify I am in good health and properly trained to run the distance of this race. I assume all risks associated with running in this event, all risks being known and being appreciated by me. I understand my entry fee is non-refundable. Having read this waiver and knowing these facts, and considering your accepting my entry into this running event, I, for myself and my estate, heirs, survivors, descendants and anyone on whose behalf I may act (including all minor children and charges and their estates heirs and survivors), do hereby permanently and forever completely give up, surrender, waive, release and terminate any and all claims or liabilities of any kind, arising in tort, contract or otherwise, against Southeast Rotary Club, Fairbanks Community Center, Drew Lewis Foundation and ActNow Promotions/Racing, and their respective officials, directors, trustees, agents, volunteers, employees, sponsors and affiliates arising from my participation in this event, including but not limited to claims arising out of past or future negligence or carelessness on their part. I hereby consent to the use of image in photographs, videos and other recordings for promotional purposes.Registration fees are nonrefundable.
